These Terms of Service ("Terms") govern your access to and use of Digitoly Canvas ("Digitoly Canvas", "we", "us", or "our"). By creating an account or using Digitoly Canvas, you agree to these Terms.

Using the service

Digitoly Canvas provides tools for creating, managing, and exporting digital brand assets and designs. You agree to use the service only for lawful purposes and in accordance with these Terms.

You must not use Digitoly Canvas to upload, create, store, or distribute content that violates applicable laws or infringes the rights of another person or organization.

You are responsible for ensuring that you have the necessary rights, permissions, or licenses to use any content you upload or use through Digitoly Canvas, including logos, images, videos, fonts, trademarks, and other intellectual property.

Your account

You are responsible for maintaining the security of your account and for activity that occurs through your account. You agree to provide accurate information when creating your account and to keep your account information reasonably up to date.

You must not attempt to gain unauthorized access to another user's account, circumvent security measures, interfere with the service, or use the service in a way that could damage or disrupt Digitoly Canvas.

Social login

Digitoly Canvas may allow you to sign in using third-party authentication services such as Google or Facebook/Meta. Your use of those authentication services may also be subject to the terms and policies of the respective provider.

By using a third-party login option, you authorize the applicable provider to authenticate your account and provide Digitoly Canvas with the information necessary to create or access your account, as described in our Privacy Policy.

Your content

You retain ownership of the brand assets, images, videos, designs, and other content that you upload to or create using Digitoly Canvas, except for any rights that you do not own or that belong to third parties.

You grant Digitoly Canvas the limited rights necessary to host, store, process, display, reproduce, and render your content solely for the purpose of providing and operating the service for you.

We do not claim ownership of your brand assets or designs simply because you upload or create them using Digitoly Canvas.

Prohibited activities

You may not use Digitoly Canvas to engage in unlawful activity, infringe intellectual property or other rights, distribute malicious software, attempt unauthorized access to systems or accounts, interfere with the operation of the platform, or abuse the service in a manner that could negatively affect other users.

We may take reasonable action, including restricting or suspending access, when necessary to protect the service, our users, or third parties from abuse, security threats, or violations of these Terms.

Account termination

You may stop using Digitoly Canvas and request deletion of your account at any time.

We may suspend or terminate access to an account if we reasonably believe that the account has violated these Terms, has been used for unlawful or abusive activity, presents a security risk, or is being used in a way that could harm the service or other users.

Where appropriate, we may provide notice before taking action, except where immediate action is reasonably necessary for security, legal, or operational reasons.

Service availability

Digitoly Canvas is provided on an "as is" and "as available" basis. We work to keep the service reliable and available, but we do not guarantee that the service will always be uninterrupted, error-free, secure, or available at all times.

Features may be added, changed, suspended, or discontinued as Digitoly Canvas develops and evolves.

Third-party services

Digitoly Canvas may rely on third-party services for authentication, hosting, storage, databases, security, and other infrastructure. Third-party services may have their own terms and policies, and your use of those services may be subject to their respective agreements.

Intellectual property

The Digitoly Canvas service, including its software, interface, branding, design, features, and underlying technology, is owned by or licensed to Digitoly Canvas and is protected by applicable intellectual property laws.

These Terms do not grant you ownership of Digitoly Canvas or its underlying technology. You receive only the rights necessary to use the service in accordance with these Terms.

Limitation of liability

To the maximum extent permitted by applicable law, Digitoly Canvas and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the service.

Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.

Changes to these terms

We may update these Terms from time to time as Digitoly Canvas evolves or as required by applicable law.

When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of Digitoly Canvas after updated Terms become effective is subject to the revised Terms, where permitted by applicable law.
